1. INTRODUCTION
Edwards Psychiatry ("we," "us," "our," or "the Practice") is a private pay psychiatric practice located in Seattle, Washington, founded by Domenique Edwards, MSN, ARNP, PMHNP-BC. We provide psychiatric evaluations, ADHD testing, medication management, ADHD coaching, and genetic testing services to clients in Washington State.
We are committed to protecting your privacy and handling your personal and health information with care, transparency, and in accordance with applicable laws. This Privacy Policy explains what information we collect, how we use it, who we share it with, how we protect it, and what rights you have regarding your data.
This policy applies to all information collected through our website (www.edwardspsychiatry.org), our client portal (IntakeQ), our booking systems, our telehealth platform, and any direct communications with our practice via phone, email, video, or in-person interactions.

2. INFORMATION WE COLLECT

Personal Identification Information: Full name, date of birth, gender identity, pronouns, mailing address, email address, and phone number.
Health and Medical Information: Psychiatric history, medical history, medication history, substance use history, developmental history, social and familial background, diagnostic information, treatment plans, progress notes, ADHD testing results (including QbCheck data), genetic testing results, and any other information you share during evaluations, sessions, or through intake forms.
Payment and Billing Information: Credit or debit card numbers, HSA/FSA card details, Zelle account information, Venmo account information, billing address, and transaction records.
Insurance Information: If applicable, we may collect insurance details for the purpose of providing superbills for out-of-network reimbursement.
Communication Records: Emails, secure messages sent through the IntakeQ patient portal, voicemails, text messages, and records of phone or video call interactions.
Technical and Website Data: IP address, browser type, device type, operating system, pages visited on our website, referring URLs, and general geographic location data collected through cookies and analytics tools when you visit our website.
Appointment and Scheduling Data: Dates, times, service types, and provider assignments associated with your appointments, whether booked through IntakeQ, Tebra, or Square (for coaching services).
Emergency Contact Information: Name, relationship, and phone number of your designated emergency contact.

Intake Forms and Client Portal: Through the IntakeQ secure client portal, where you complete intake questionnaires, consent forms, health history forms, and other documents required to begin and continue care.
Booking and Scheduling Platforms: Through Tebra (for psychiatric appointment booking), IntakeQ (for scheduling and self-booking), and Square (for ADHD coaching appointments).
Direct Communication: Information you provide during phone calls, email exchanges, secure portal messages, video consultations, and in-person visits.
Telehealth Sessions: Information shared during virtual appointments conducted through our HIPAA-compliant telehealth platform.
ADHD Testing: Data generated from the QbCheck FDA-approved psychometric test completed remotely and interpreted by your provider.
Genetic Testing: Results and data from pharmacogenomic testing used to guide medication recommendations.
Payment Processing: Payment details provided at the time of service through our accepted payment methods (Zelle, Venmo, credit/debit cards, HSA/FSA cards).

Third-Party Referrals: Information received from other healthcare providers, schools, or professionals who refer you to our practice with your consent.
4. HOW WE USE YOUR INFORMATION
We use the information we collect for the following purposes:
Providing Clinical Services: To conduct psychiatric evaluations, ADHD testing, medication management, ADHD coaching, and genetic testing interpretation. This includes formulating diagnoses, creating individualized treatment plans, prescribing medications, and monitoring your care.
Appointment Management: To schedule, confirm, reschedule, and send reminders for your appointments across our booking platforms.
Communication: To respond to your inquiries, communicate about your care, send appointment reminders, and provide follow-up information through the IntakeQ portal, email, phone, or text.
Payment Processing: To process payments for services rendered, issue receipts, and provide superbills for out-of-network insurance reimbursement if requested.
Care Coordination: To collaborate with other healthcare providers involved in your care, with your written consent, to ensure comprehensive and integrated treatment.
Quality Improvement: To evaluate and improve the quality of our services, clinical processes, and client experience.
Legal and Regulatory Compliance: To comply with applicable federal, state, and local laws and regulations, including HIPAA, Washington State health record retention requirements, and mandatory reporting obligations.
Website Analytics and Improvement: To understand how visitors use our website, improve site functionality, and enhance user experience. This data is collected in aggregate form and does not identify individual users.
Marketing and Outreach: If you opt in, we may use your email address to send educational content, practice updates, or newsletters. You may unsubscribe at any time. We will never sell your personal or health information for marketing purposes.
5. WHO WE SHARE YOUR INFORMATION WITH
We do not sell your personal or health information to any third party. We may share your information only in the following circumstances and with the following types of recipients:
Electronic Medical Records (EMR) Provider: IntakeQ serves as our secure electronic medical records and client portal system. Your health information, intake forms, appointment history, and secure messages are stored within IntakeQ's HIPAA-compliant platform.
Booking and Scheduling Platforms: Tebra is used for psychiatric appointment scheduling and provider listings. Square is used for booking ADHD coaching sessions. These platforms receive limited scheduling and contact information necessary to manage your appointments.
Payment Processors: Payment information is processed through secure third-party payment processors associated with Zelle, Venmo, and credit/debit card networks. Edwards Psychiatry does not store your full payment card details on our systems.
Website Hosting and Analytics: Our website is hosted on a third-party platform and may use analytics tools (such as Google Analytics or similar services) to collect anonymized usage data. These providers may use cookies and similar technologies as described in Section 10.
Other Healthcare Providers: With your written consent, we may share relevant health information with your primary care physician, therapist, or other healthcare providers involved in your care to support coordinated treatment.
Genetic Testing Laboratories: If you undergo pharmacogenomic testing, your genetic sample and relevant health information may be shared with the laboratory performing the test, in accordance with their own privacy policies and HIPAA requirements.
ADHD Testing Platforms: QbCheck testing data is processed through the QbCheck platform in accordance with their privacy and security protocols.
Legal and Regulatory Authorities: We may disclose your information when required by law, including but not limited to mandatory reporting of child abuse or neglect, elder abuse, threats of harm to self or others, or in response to a valid court order or subpoena.
Professional Consultants: We may consult with other licensed professionals about your care for clinical purposes. In such cases, identifying information is minimized or removed to the greatest extent possible.
Business Operations: We may share limited information with trusted service providers who assist with practice operations, such as IT support, billing services, or administrative support. These providers are bound by confidentiality agreements and are required to protect your information.
ADHD Coaching Partner: ADHD coaching services are provided through a partnership with an independent business. If you participate in coaching, limited information necessary to facilitate your coaching sessions may be shared with the coaching provider. Coaching services are not classified as licensed mental health services.
6. HOW LONG WE KEEP YOUR INFORMATION
We retain your personal and health information in accordance with applicable laws and professional standards:
Medical and Mental Health Records: In accordance with Washington State law (RCW 70.41.190 and WAC 246-918-190), we retain adult client records for a minimum of ten (10) years following the last date of service or contact. For minor clients, records are retained for a minimum of ten (10) years or until three (3) years after the client reaches the age of eighteen (18), whichever is longer.
Billing and Financial Records: Payment records and financial documentation are retained for a minimum of seven (7) years in accordance with IRS requirements and applicable state law.
Website and Analytics Data: Anonymized website usage data may be retained indefinitely for the purpose of analyzing trends and improving our website.
Communication Records: Emails, secure messages, and other correspondence related to your care are retained as part of your client record and follow the same retention schedule as medical records.
When the applicable retention period expires, your information will be securely destroyed or permanently de-identified using methods appropriate to the format of the data (such as secure shredding for paper records or certified data wiping for electronic records).
If you request deletion of your information, we will honor your request to the extent permitted by law. Certain records may need to be retained to comply with legal, regulatory, or professional obligations as described above.
7. HOW WE PROTECT YOUR INFORMATION
We take the security of your personal and health information seriously and implement the following safeguards:
Encryption: Data transmitted between your device and our website, client portal, and telehealth platform is protected using industry-standard encryption protocols (such as SSL/TLS).
Access Controls: Access to your health information is limited to authorized members of the Edwards Psychiatry team who need it to provide your care or support practice operations. Each team member has unique login credentials, and access permissions are role-based.
Secure Platforms: We use HIPAA-compliant platforms for our electronic medical records (IntakeQ), telehealth sessions, and client communications. These platforms maintain their own security certifications and undergo regular security assessments.
Password Protection and Multi-Factor Authentication: Our systems utilize strong password requirements and, where available, multi-factor authentication to prevent unauthorized access.
Staff Training: All Edwards Psychiatry team members receive training on HIPAA regulations, privacy practices, and data security protocols. Team members are required to sign confidentiality agreements.
Physical Security: For in-person visits, paper documents containing personal or health information are stored in locked and secured areas with restricted access.
Secure Disposal: When records reach the end of their retention period, they are destroyed using secure methods including shredding for paper documents and certified data wiping for electronic files.
Business Associate Agreements: We maintain Business Associate Agreements (BAAs) with all third-party service providers who may access, store, or process Protected Health Information on our behalf, as required by HIPAA.
Incident Response: We have procedures in place to detect, respond to, and mitigate data security incidents. See Section 16 for our data breach notification procedures.
While we implement robust security measures, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security but are committed to using commercially reasonable safeguards to protect your information.
8. YOUR RIGHTS REGARDING YOUR INFORMATION
As a client of Edwards Psychiatry, you have the following rights regarding your personal and health information:
Right to Access: You have the right to request a copy of your health records and personal information that we maintain. We will provide the requested information within thirty (30) days of receiving your written request. A reasonable fee may be charged for copying and mailing records.
Right to Amend: If you believe that information in your records is inaccurate or incomplete, you have the right to request a correction. We will review your request and respond within sixty (60) days. If we deny the request, we will provide a written explanation and you may submit a statement of disagreement to be included in your record.
Right to Restrict: You have the right to request restrictions on how we use or disclose your health information. While we will consider your request, we are not required to agree to all restrictions. However, if you pay for a service in full out of pocket and request that we not share information about that service with a health plan, we are required to honor that restriction.
Right to Confidential Communications: You may request that we communicate with you through a specific method or at a specific location. For example, you may ask that we contact you only by email or only at a certain phone number.
Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your health information. This does not include disclosures made for treatment, payment, or healthcare operations, or disclosures you authorized in writing.
Right to a Copy of This Policy: You have the right to obtain a paper or electronic copy of this Privacy Policy at any time by contacting our office.
Right to File a Complaint: If you believe your privacy rights have been violated, you have the right to file a complaint with Edwards Psychiatry or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
Right to Revoke Authorization: If you have provided written authorization for us to use or disclose your information for a specific purpose, you have the right to revoke that authorization in writing at any time. Revocation will not affect any disclosures made prior to receiving your written revocation.
Right to Deletion: You may request deletion of your personal information. We will comply with your request to the extent permitted by law. Please note that we are required to retain certain records for the periods described in Section 6 and cannot delete information that is legally required to be maintained.
To exercise any of these rights, please contact us using the information provided in Section 18 of this policy. We may require you to submit your request in writing and to verify your identity before processing your request.
9. NOTICE OF PRIVACY PRACTICES (HIPAA)
Edwards Psychiatry is committed to complying with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the HITECH Act, and their implementing regulations, as well as applicable Washington State privacy laws.
This section serves as our Notice of Privacy Practices and describes how your Protected Health Information (PHI) may be used and disclosed, and how you can access this information.
Uses and Disclosures of PHI for Treatment, Payment, and Healthcare Operations:
Treatment: We may use and disclose your PHI to provide, coordinate, and manage your psychiatric care and related services. This includes sharing information among members of your treatment team within Edwards Psychiatry and, with your consent, with external providers involved in your care.
Payment: We may use and disclose your PHI to process payments for services provided. As a private pay practice, this primarily involves generating superbills for out-of-network insurance reimbursement upon your request.
Healthcare Operations: We may use and disclose your PHI for purposes related to running our practice, including quality improvement activities, staff training, licensing, and administrative functions.
Uses and Disclosures That Do Not Require Your Authorization:
We may use or disclose your PHI without your authorization in limited circumstances as permitted or required by law, including:
- When required by federal, state, or local law
- For public health activities, such as reporting communicable diseases
- To report suspected abuse, neglect, or domestic violence as required by Washington State law
- To comply with health oversight activities
- In response to a court order or lawful subpoena
- To avert a serious threat to the health or safety of a person or the public
- For specialized government functions, such as military or veterans' activities
- For workers' compensation purposes as authorized by law
- To coroners, medical examiners, and funeral directors as permitted by law
- For approved research purposes with appropriate safeguards
Uses and Disclosures That Require Your Written Authorization:
For uses and disclosures not described above, we will obtain your written authorization before using or disclosing your PHI. This includes, but is not limited to:
- Most uses and disclosures of psychotherapy notes (if maintained separately)
- Uses and disclosures for marketing purposes
- Sale of your PHI
You may revoke any written authorization at any time by submitting a written request to our office. Revocation will not apply to actions already taken in reliance on the authorization.
Your HIPAA Rights: Your rights under HIPAA are described in detail in Section 8 of this policy.
Our Duties: We are required by law to maintain the privacy and security of your PHI, to provide you with this Notice of our legal duties and privacy practices, to notify you in the event of a breach of your unsecured PHI, and to follow the terms of this Notice currently in effect.

Edwards Psychiatry offers telehealth services, including virtual psychiatric evaluations, medication management appointments, ADHD coaching sessions, and ADHD testing interpretation visits.

Platform Security: Our telehealth sessions are conducted through HIPAA-compliant platforms that use encryption to protect the confidentiality of your communications.
Your Responsibilities: You are responsible for ensuring that you are in a private, secure location during telehealth sessions. We recommend using a secure, password-protected internet connection and a private space where others cannot overhear your conversation.
Recording: Edwards Psychiatry does not record telehealth sessions. You are asked not to record sessions without the express written consent of your provider.
Limitations: While telehealth technology is designed to be secure, there are inherent risks associated with electronic communication, including the potential for technology failures, unauthorized access, or interception. By using our telehealth services, you acknowledge these risks.
Data from Telehealth: Information shared during telehealth sessions is documented in your medical record within our EMR system (IntakeQ) and is subject to the same privacy protections as information obtained during in-person visits.

Reviews and Testimonials: If you choose to leave a public review about our practice, please be aware that we are unable to respond in a way that confirms or denies a treatment relationship, in order to protect your confidentiality. We appreciate your feedback and encourage you to share your experience if you are comfortable doing so.
15. CHILDREN'S PRIVACY
Edwards Psychiatry provides services to children and adolescents. We take special care to protect the privacy of minor clients.
Parental/Guardian Consent: For clients under the age of thirteen (13), we require a parent or legal guardian to consent to the collection and use of the child's personal and health information.
Washington State Minor Consent Laws: In accordance with Washington State law, minors aged thirteen (13) and older may consent to certain mental health services without parental consent. In such cases, the minor's health information may be protected from disclosure to parents or guardians as provided by law.
Website Data: Our website is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen through our website. If we become aware that we have inadvertently collected personal information from a child under thirteen through our website without parental consent, we will take steps to delete such information.
16. DATA BREACH NOTIFICATION
In the event of a breach of your unsecured Protected Health Information, Edwards Psychiatry will comply with all applicable federal and state breach notification requirements.
Notification Procedures:
Individual Notification: We will notify affected individuals in writing (by first-class mail or, if you have agreed to electronic communication, by email) without unreasonable delay and no later than sixty (60) days after discovery of the breach. The notification will include a description of the breach, the types of information involved, steps you should take to protect yourself, what we are doing in response, and contact information for further questions.
HHS Notification: If the breach affects 500 or more individuals, we will notify the U.S. Department of Health and Human Services without unreasonable delay and no later than sixty (60) days after discovery. For breaches affecting fewer than 500 individuals, we will report to HHS on an annual basis.
Media Notification: If the breach affects 500 or more residents of a single state or jurisdiction, we will provide notice to prominent media outlets serving that area.
Washington State Requirements: We will also comply with Washington State's data breach notification law (RCW 19.255.010), which may require notification to affected individuals and the Washington State Attorney General's Office.
Mitigation: In the event of a breach, we will take prompt action to mitigate harm, investigate the cause, and implement measures to prevent future breaches.
